System Violations

In accordance with the Terms and Conditions of Use, no registrant may excessively use or gather information beyond the intended purpose of the system.  Organizations and registrants who violate this agreement will be temporarily or permanently banned.

 

System usage is monitored and logged. When it is determined that a registrant has improperly used the system, usage will be restricted, and a violation will be issued based on the improper activity.

 

Excessive Use Violations

An Excessive Use violation is defined as exceeding the number of searches allowed during a specific period.  Automation applications used to operate any part of the system are prohibited and violate the Terms and Conditions of Use.

 

Criteria Search Violations

A Criteria Search violation is defined as exceeding the number of similar searches allowed while using the Search screen.  Attempting to match any unknown criteria on the Search screen is prohibited and violates the Terms and Conditions of Use.

 

Important! To avoid receiving Criteria Search violations, it is highly recommended that users enter a complete, or as close to complete as possible, First Name when searching the system.

 

Temporary/Permanent Bans

Depending on the violation type, for security purposes, registrants can be either temporarily or permanently banned from using the system.  When a ban is enforced, the registrant is automatically logged out of the system.  A message indicating that the account is banned will be displayed.  Automatic email notifications will be sent to all administrators and the registrant(s) who caused the ban.


Note: Any ban on the system is determined by a cumulative number of violations, which is not reset following a previous ban. Therefore, once a ban is lifted, even a single additional violation based on the same search criteria could potentially trigger a subsequent ban. 

 

Temporary Bans

The system enforces a temporary ban prohibiting access from one hour up to seven days.  When a violation of the Terms and Conditions of Use is detected, the registrant is logged out of the system and will be unable to log in again until the temporary ban expires.   Automatic email notifications to the registrant and the account administrator will be sent providing details regarding the ban.

 

After the time allotted for the violation ban has lapsed, the registrant may access and continue using the system.

Permanent Bans

The system enforces a permanent ban prohibiting organizations and its users from using the system indefinitely.  When multiple Terms of Use violations are detected, the user is automatically logged out of the system and will be unable to log in again until the permanent ban is lifted by a system administrator.

 

Detection of multiple Terms of Use agreement violations will bar access to the system.  The VDBC will enforce a permanent ban prohibiting the organization and its users indefinitely.  Automatic email notifications to the user and the account administrator will be sent providing details regarding the ban.

 

Registrants who believe this action is in error, and want to continue using the system, or feel the ban was enforced in error should contact vdbcinquiry@vacourts.gov.
