Terms and Conditions of Use

By using the Virginia Judiciary Online Payment System ("System"), you agree to the following applicable terms and conditions of use, as they currently appear and as they may be amended.

Use of this System

THIS SYSTEM MAY ONLY BE USED TO PROCESS PAYMENTS OF FINES, FEES, RESTITUTION AND COSTS FOR TRAFFIC AND CRIMINAL CASES DISPOSED OF IN THE CIRCUIT OR JUVENILE AND DOMESTIC RELATIONS DISTRICT (JDR) COURT, AND FEES FOR CIVIL CASES IN THE JDR COURT. PAYMENTS IN CASES SEALED BY THE CIRCUIT OR JDR COURT, OR THAT ARE NOT VIEWABLE, CANNOT BE MADE USING THIS SYSTEM. PRIOR TO MAKING PAYMENT, PLEASE CAREFULLY READ ALL INSTRUCTIONS. ANY REFUND MUST BE OBTAINED FROM THE CIRCUIT OR JDR COURT TO WHICH PAYMENT WAS MADE.

Disclaimer about this System

The circuit or JDR court case information displayed within this System is case information entered by the respective circuit and JDR court clerks. By law, the circuit court clerks are the custodians of the records of their courts. The JDR clerks are charged with retaining and storing their JDR court's records. The Office of the Executive Secretary (OES) of the Supreme Court of Virginia is the administrative office for Virginia's Judicial System and provides the technology support to operate this System. Any financial transaction conducted through this System is between you and the respective circuit or JDR court clerk. The processing of credit card payments is provided by Elavon Inc., which may have separate and independent terms and conditions of use.

Collected Information and Usage

This System collects information you provide to facilitate processing of your payment. Some information, including your email address and last four digits of the provided credit card number, may be stored on secure servers for a period not exceeding 90 days from the date of payment for accounting and payment verification purposes. This information will not be utilized to facilitate future payments.

Information Sharing

OES may disclose personal information if required to do so by law or to address a particular complaint, or if it believes that such action is necessary to prevent fraud or criminal conduct or to protect OES or the rights, property, or personal safety of any person.

Your Internet Service Provider (ISP) may have access to your communications between your equipment and the System. For information regarding your ISP's treatment of your information, please consult your ISP about its privacy policies.

Security

OES places great importance on the security of all sensitive personal information associated with its users including date of birth, social security numbers and credit card account information. Security measures are in place to attempt to protect against the loss, misuse, and alteration of sensitive personal information under our control. Only authorized personnel have access to sensitive personal information. Although OES cannot guarantee that loss, misuse, or alteration of information will never occur; it uses reasonable efforts to prevent it. By using this System, you acknowledge that OES cannot guarantee the security of your sensitive personal information.

PLEASE TAKE NOTICE THAT ALTHOUGH THE TRANSMISSION OF DATA BETWEEN THE SYSTEM AND ITS SERVERS IS SECURE, OES IS NOT RESPONSIBLE FOR THE SECURITY OF YOUR PERSONAL INTERNET CONNECTION, INCLUDING ANY WIRELESS CONNECTION.

IF THE SYSTEM IS ACCESSED OUTSIDE OF THE UNITED STATES, THE COUNTRIES CONCERNED MAY NOT HAVE DATA PROTECTION LAWS SIMILAR TO THOSE IN THE UNITED STATES.

Payment Authorization

By providing your credit card account information, you represent that you are authorized to use the card and you authorize the circuit or JDR court clerk to charge your credit card in the amount indicated in your payment instructions. OES reserves the right to block or terminate payment activity, or to remove or edit content other than case information. Neither the termination nor suspension of your use of this System shall affect your liability or obligations for timely payment of your court fines, fees, restitution and costs.

Liability for Returned Payments

In the event your online payment is not processed or authorized by your credit card company or financial institution, your liability to the circuit or JDR court will not change. You remain liable for any fines, fees, restitution and costs. OES and the circuit or JDR court will not accept liability for a payment not processed, refused, or declined by the credit card supplier. You must verify with your credit card company or financial institution that the payment is processed.

Other Legal Terms and Conditions

OES reserves the right to change or terminate this System and these Terms and Conditions of Use, in its sole discretion and at any time, without notice to you except as may be required by law. OES shall not be deemed to have waived any of its rights or remedies hereunder unless such waiver is in writing and signed by an authorized representative of OES.

The laws of the Commonwealth of Virginia shall govern the interpretations, validity, performance and enforcement of these Terms and Conditions of Use. Any disputes or other actions arising out of the Terms and Conditions of Use shall be brought in the City of Richmond, Virginia, and the parties hereby agree that exclusive venue shall lie in Richmond, Virginia. If any of these terms and conditions shall be deemed invalid, void or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining terms or conditions of use.

Disclaimer of Warranties and Limitation of Liability

Every effort is made to provide accurate and current information through the System. However, due to updating cycles and resources, you may encounter some inaccurate or outdated information. OES makes no warranties regarding the availability of the System or the accuracy, reliability, or content of the information provided. OES disclaims any responsibility or liability for errors, omissions, and the inaccuracy of any information. Users of this System have the responsibility to verify the accuracy, timeliness, and completeness of the information.

Due to the complex nature of the Internet, OES does not warrant that access to this System or the operation or performance of the System will be uninterrupted or error-free. THE SYSTEM IS SUBJECT TO LIMITATIONS, DELAYS, AND PROBLEMS INHERENT WITH THE INTERNET.

You expressly understand and agree that, to the maximum extent permitted by applicable law, the site, services, and materials are provided by OES on an "as is" basis without warranty of any kind, including express, implied, statutory, or fitness for a particular purpose. By accessing and using the System, you accept all risks of loss or damage resulting from your access and use of the System.

No advice or information, whether oral or written, obtained by you from OES through or from use of the System shall create any warranty not expressly stated in these Terms and Conditions of Use.

You acknowledge that in no event shall OES, its agents, directors, employees, partners, or suppliers be liable to you or any third party for any direct, special, incidental, indirect, consequential, or punitive damages, including those that may result from loss of use, data or profits, whether or not foreseeable, or if OES has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with your use of or access to the site, System or materials.
